By accessing and using PriceMaker ("Service"), a service provided by EZ Cloud LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
PriceMaker is an automated repricing solution for e-commerce sellers on platforms such as Amazon, Walmart, and eBay. We provide tools to automate price adjustments based on rules and strategies defined by the user.
3. User Accounts
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
4. Subscription and Payments
The Service is billed on a subscription basis. You agree to pay the fees associated with your chosen subscription plan. We reserve the right to modify our pricing and billing methods at any time, with notice to you.
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as outlined in that policy.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of EZ Cloud LLC and its licensors. The Service is protected by copyright, trademark, and other laws.
7. Limitation of Liability
In no event shall EZ Cloud LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
